Welcome to ROADY! These Terms of Service ("Terms") govern your use of the ROADY mobile application and any related services provided by ROADY ("the App" or "we"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.
1. Overview of Services
ROADY is a platform that connects users ("Users") with roadside assistance providers, including mobile mechanics, towing services, mobile tire repair, locksmiths, and other related services. The App allows Users to request assistance based on their location and needs.
2. Privacy and Data Usage
a. Data Collection
By using the App, you acknowledge and agree that we collect, use, and share the following personal information for the proper operation of the App:
- Your Name: is used to identify you within the App and for service interactions.
- Your Phone Number: is used to contact you regarding your service requests and for communication with service providers.
- Your Location: is essential for connecting users with nearby service providers and ensuring timely assistance.
b. Data Usage
We may use your personal information for the following purposes:
- Display to Service Providers: Your name, phone number, and location may be shared with service providers to facilitate the delivery of services you request.
- Internal Operations: Your data may be used for analytics, service improvements, and other operational needs.
- Legal and Compliance: We may disclose your information if required by law or in response to legal processes.
c. Data Sharing
You understand and agree that your personal information, including your name, phone number, and location, may be publicly displayed or shared with third parties as necessary for the operation of the App. We do not guarantee the privacy of your data when it is shared with service providers or other third parties.
3. User Responsibilities
a. Accurate Information
You agree to provide accurate and up-to-date information when using the App. This includes your name, phone number, and location. Providing false or misleading information may result in the termination of your account.
b. Compliance with Laws
You agree to use the App in compliance with all applicable laws and regulations. Any misuse of the App may result in termination of your account and legal action.
4. Service Providers
a. Independent Contractors
Service providers listed on ROADY are independent contractors and are not employees of ROADY. We do not endorse, guarantee, or assume responsibility for the services provided by these independent contractors.
b. Ratings and Reviews
You may be asked to rate and review the services you receive. Your reviews should be honest and based on your personal experience. We reserve the right to remove any reviews that are false, defamatory, or violate our guidelines.
5. Payment and Fees
When you request a service through the App, you agree to pay the estimated service fee calculated based on your location and the service provider's rates. A 15% referral fee is deducted from the total service fee before the remaining amount is transferred to the service provider. The service provider will be paid only if they accept the job, and your card will only be charged upon acceptance. There are no refunds if the job is accepted, and the service provider arrives within a reasonable time and is prepared to perform the service. Additional costs for supplies, such as parts and fuel, may be needed and are not included in the service call fees.
6. Acceptance of Jobs
Service providers must promptly accept or decline service requests. Once a job is accepted, the service provider is responsible for completing the job as agreed. If the provider cannot fulfill the job, they must notify the customer immediately and arrange for a refund of the service fee within 24 hours. The customer will be notified via text message when the job is accepted, including the provider's contact information.
7. Limitation of Liability
a. No Warranty
ROADY provides the App on an "as is" and "as available" basis. We make no warranties or representations regarding the reliability, accuracy, or completeness of the App or the services provided through it.
b. Limitation of Liability
To the maximum extent permitted by law, ROADY shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App or the services provided.
8. Termination
a. Termination by ROADY
We reserve the right to terminate or suspend your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.
b. Termination by User
You may terminate your account at any time by discontinuing your use of the App.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.
10. Changes to the Terms
We may update these Terms from time to time. If we make significant changes, we will notify you by posting the new Terms on the App. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.
